Le juge de paix d\u00e9signe alors un administrateur provisoire, qui n\u2019est pas n\u00e9cessairement une personne connue ou choisie par le concern\u00e9. Cette situation, bien qu\u2019encadr\u00e9e, peut g\u00e9n\u00e9rer de la frustration, des tensions familiales ou des retards dans les d\u00e9cisions urgentes (ex.<span class=\"s1\">\u202f<\/span>: vente d\u2019un bien pour financer une maison de repos).<br \/><br \/><\/p><p class=\"p1\">En anticipant via un mandat extrajudiciaire, le mandant conserve la ma\u00eetrise de sa trajectoire. Il peut pr\u00e9voir que certains actes ne soient autoris\u00e9s qu\u2019avec l\u2019accord d\u2019un tiers, comme la vente du logement familial. Les pouvoirs peuvent \u00eatre modul\u00e9s en fonction de l\u2019\u00e9volution de l\u2019\u00e9tat de sant\u00e9, permettant une gestion progressive. Le mandat peut aussi inclure des conditions sp\u00e9cifiques pour son entr\u00e9e en vigueur, par exemple la validation par deux m\u00e9decins ind\u00e9pendants. Enfin, des r\u00e8gles de contr\u00f4le et de reddition de comptes peuvent \u00eatre d\u00e9finies, assurant transparence et s\u00e9curit\u00e9. Cet enregistrement est obligatoire pour qu\u2019il produise ses effets au moment o\u00f9 le mandant devient incapable.<\/p><p>\u00a0<\/p><p class=\"p1\">Si le mandat contient des actes pour lesquels la loi exige un acte notari\u00e9, comme une donation, la vente d\u2019un bien immobilier ou la modification d\u2019un contrat de mariage, il doit n\u00e9cessairement \u00eatre pass\u00e9 devant notaire.
